By accessing or using Banana Studio's AI image editing service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

Banana Studio is an independent AI image editing platform powered by Nano Banana AI model. We provide a user-friendly interface built on top of advanced AI technology. We enhance usability and provide additional features such as:

• Natural language image editing interface
• Character consistency and scene preservation tools
• Multi-image context support
• One-shot editing capabilities

Important: We are not affiliated with, endorsed by, or sponsored by Google, OpenAI, or any AI model providers. We provide access to AI models through our custom interface.

3. User Accounts

3.1 Registration

You must create an account to use our service. You agree to provide accurate and complete information and to keep your account credentials secure.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.

4. Subscriptions and Billing

4.1 Subscription Plans

We offer various subscription plans with different features and usage limits. Subscription fees are billed in advance on a monthly or annual basis.

4.2 Payment Processing

All payments are processed securely through Creem, our third-party payment processor. By subscribing, you agree to Creem's terms and conditions.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription and cancel at any time through your account dashboard.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds are provided for partial billing periods unless otherwise required by law.

5. Refund Policy

Our commitment: We strive to provide excellent service and customer satisfaction.

5.1 Eligibility for Refunds

• Service outages or technical issues preventing normal use
• Billing errors or duplicate charges
• First-time subscription within 7 days of purchase (if you have used less than 10% of your monthly quota)

5.2 Non-Refundable Items

• Subscription renewals (you must cancel before the renewal date)
• Used quota or completed image edits
• Annual subscriptions after 30 days from purchase

5.3 Refund Request Process

Response Time: We respond to all customer requests within 3 business days. If we do not respond within this timeframe, our payment processor (Creem) reserves the right to issue a refund on our behalf to ensure customer satisfaction.

Approved refunds will be processed within 5-10 business days to your original payment method.

You own the edited images generated by our service, subject to any restrictions imposed by the underlying AI model providers. You are responsible for ensuring your use of generated content complies with applicable laws and third-party rights.

8.3 Our Service

Banana Studio's interface, design, and features are protected by intellectual property laws. You may not copy, modify, or distribute our service without permission.

9. Third-Party Services

Our service relies on third-party AI models and services. We are not responsible for:

• Availability or performance of third-party AI models
• Content generated by third-party AI models
• Changes to third-party pricing or terms
• Data handling practices of third-party providers

10. Disclaimers and Limitations

10.1 Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. We are not liable for service interruptions caused by third-party providers, maintenance, or factors beyond our control.

10.2 AI-Generated Content

AI-generated content may be unpredictable or contain errors. We do not guarantee the accuracy, quality, or appropriateness of generated content. You are responsible for reviewing and using generated content at your own risk.

10.3 Limitation of Liability

To the maximum extent permitted by law, Banana Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our service.

11. Termination

We reserve the right to suspend or terminate your account if you violate these terms or engage in prohibited activities. You may terminate your account at any time by canceling your subscription and contacting support.
